Indemnity
You agree to indemnify, defend and release from all liability Airsens SAS / Sight Design LLC, its subsidiaries and their administrators, directors, employees, agents, shareholders, representatives, providers of respective content and services and against any loss, expense, damage and cost, including reasonable legal fees, resulting from any violation of these general conditions or any activity related to your Joomeo account (including negligent or illicit conduct) by you or any other person accessing the website and using your internet account, user name for the Joomeo website or account password.
Applicable law
Use of this website is governed by French law. You agree to accept the jurisdiction of the commercial court of Lyon for any legal procedure resulting from these General Conditions or of your use of the Joomeo website. Any cause for action or complaint you may have related to the Joomeo website (including without being limited to your purchase of Airsens SAS / Sight Design LLC products) must be begun within one (1) year after the cause of action or complaint takes place.
Website changes; cancellation
Airsens SAS / Sight Design LLC reserves the right to modify or interrupt, temporarily or definitively, the website, and the products and services available on the website, including, but not limited to, modifying and/or deleting features or other information without providing prior notice. You accept that Airsens SAS / Sight Design LLC cannot be held responsible towards you for any modification, suspension, interruption or cancellation of the website, any constitutive element of the website or any product or service available on the website (including without being limited to the cancellation of any User content). Airsens SAS / Sight Design LLC reserves the right, at its sole discretion, immediately and without providing notice, to suspend or cancel your account and/or your ability to access the website and products and services available on the website for any reason.
Prices and payment
Joomeo uses an online, reliable and safe payment system. Two payment options are available: payment by credit card and payment through Paypal. All offer subscriptions will be considered confirmed once our service center receives approval from the bank or payment center. If payment is refused, the order will be cancelled.
The applicable prices are the prices indicated at the date and time of subscription to the Joomeo offer. Any subsequent price modification will not be applicable retroactively.
Joomeo offers you the option to make monthly payments with automatic renewal. A subscriber who chooses to make monthly payments may de-activate the automatic renewal option for his/her subscription at any time: visit "MY ACCOUNT" through the Joomeo space, click on the link "Do you want to de-subscribe?" and then confirm this action.
Special conditions applicable to printing services
- Request to cancel orders in the event of a delay
In accordance with article L 114-1 of the Consumer Code, if delivery is delayed over 7 days beyond the time period indicated in our order shipment confirmation email, you have 60 days to cancel your order without charge, by registered mail with return receipt, and receive reimbursement for the price paid, by contacting our customer service department.
- Right of withdrawal
Photographic film development service, or photo printing on any material, is considered a provision of goods performed to your specifications and specifically customized, which cannot be returned, according to the terms of article L. 121-20-2, paragraph 3 and article L. 121-20-2 paragraph 1 of the Consumer Code. Any right of withdrawal is therefore excluded once the order is paid for and confirmed.
- Price and payment
The applicable prices are indicated on the date and at the time of order confirmation. Any subsequent price modification will not be retroactively applicable. All prices are in Euro, French VAT included. You will be provided with detailed information on the goods and services selected for each order as well as shipping fees before order approval.
Joomeo has a reliable and secure online payment system. Two methods of payment are available: by credit card or by Paypal. All orders are considered approved once our company receives agreement from the bank payment center concerned. If the latter is refused, the order will be canceled and archived. - Guarantee
If an order is received incomplete (missing elements...) or content is defective you may file a complaint by sending written notification to our customer service department within 14 days of receiving your offer. You must provide your order reference information in all of your correspondence.
Only technical problems or defects concerning the state of the art will be considered as acceptable complaints. A difference in the shade of color between the printed material and the original file will not be considered as a defect. Generally, claims cannot be made concerning any aesthetic defect of the final item (size, exposure...) that could depend on the quality of the original file sent to Joomeo.
If a complaint is accepted by our customer service department, Joomeo will offer to replace or improve the product or service concerned.
Liability limit for printing services
Joomeo can only be held liable for the amount of services and/or goods ordered and paid. It will be globally limited to direct material damage. Joomeo is not liable for any other damage (immaterial, indirect...).
Failure to respect usage limits
Joomeo reserves the right, in the event that usage limits are not respected (limits are described in the 'Usage limits' paragraph of these General Conditions), to not honor orders.
Personal information
Collection of information (title, first and last names, mailing address and email address) is required for the performance of services ordered from the Joomeo website, especially in terms of service monitoring. If the information requested is not provided, the service will not be provided by the Joomeo website.
In accordance with the "Data Protection Act", law number 78-17 of January 6th 1978, you have, at any time, the right to access your personal information, you may (1) complete or modify this information if it is inaccurate or incomplete, (2) remove it and/or (3) object to its transmission by providing written notice to Joomeo through sending an email or letter to our customer service department. Joomeo informs you that data is stored by servers located in France. Your personal data will be protected using an automatic information processing system.
Miscellaneous
These General Conditions contain all of the provisions applicable between you and Joomeo for the use of the Website and Services, and prevail over any other prior agreement.
Failure to exercise any right or obligation of these General Conditions by Joomeo does not entail abandonment or renunciation of this right or obligation.
If a provision is declared void by the appropriate jurisdiction, the parties agree to modify the provision in question, without compromising the other provisions of these General Conditions.
By express agreement, electronic communication is considered to have a conclusively equivalent value to written documents.
About these general conditions
Airsens SAS / Sight Design LLC reserves the right to change, alter or modify these general conditions for any reason and at any time. Any changes made by Airsens SAS / Sight Design LLC to these general conditions will be published on the website and will immediately become effective, and will apply to you from the date of publication.
